Terms of Service

Operating entity. PINYA is operated by PINYA Travel LLC, a limited liability company organized under the laws of the District of Columbia. All references to "PINYA," "we," "us," or "our" in these Terms refer to PINYA Travel LLC. Contact: travel.sweeter@gmail.com.

Welcome to PINYA. By accessing or using our platform at pinyatravel.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service. If you do not agree to these Terms, you may not access or use PINYA.

1. Acceptance of Terms

By creating an account, accessing or using PINYA, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and PINYA. We may modify these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

PINYA is a travel planning platform that provides smart itinerary generation and travel recommendations, destination research, safety information and cultural intelligence, trip planning with budgeting and organization tools, a budget calculator and group travel expense splitting tool, travel preference management with personalized suggestions based on your interests, community itinerary sharing that allows you to share your travel plans publicly and save plans shared by others, a concierge booking service for eligible subscription tiers, an AI travel chatbox for trip-related questions, PDF export and email delivery of travel plans and recommendations. The Service uses cookies and your preferences to personalize recommendations and improve your experience. The Service is designed to assist with travel planning and research but does not provide professional travel, legal or financial advice.

3. Account Registration

To use certain features of PINYA, you must create an account via Google OAuth or other authentication methods we provide. By registering, you agree to provide accurate, current and complete information during the registration process, maintain the security of your account credentials and not share them with any third party, notify us immediately of any unauthorized access to or use of your account and accept full responsibility for all activities that occur under your account. You must be at least 13 years old to create an account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Smart Itinerary Content Disclaimer

IMPORTANT: PINYA uses artificial intelligence (powered by Anthropic's Claude) to generate itineraries, travel recommendations and other content. PINYA also uses Google Places data to verify venue details and provide location information. You expressly acknowledge and agree that smart itineraries and recommendations are suggestions only and do not constitute professional travel advice. Generated content may contain inaccuracies, outdated information, errors or omissions. You are solely responsible for independently verifying all travel details, including but not limited to flights, accommodations, visa requirements, vaccination requirements and safety conditions, before making any travel arrangements. PINYA does not guarantee the accuracy, completeness, reliability or suitability of any generated content for any particular purpose. Recommendations do not constitute endorsements or warranties of any business, destination, service or product mentioned therein. Google Places data is provided subject to Google's terms of use and may not reflect current business hours, availability or pricing. You agree to hold PINYA harmless from any claims, damages or losses arising from your reliance on generated content.

5. Subscription Tiers and Billing

5.1 Service Tiers

PINYA offers three subscription tiers. The Free Tier includes basic trip planning and destination saving with usage limits (one smart itinerary per month, up to five days per itinerary, up to five saved itineraries). The Premium Tier ($9.99 per month or $99.99 per year) provides higher limits (five smart itineraries per month, up to seven days per itinerary, up to 50 saved itineraries) plus the ability to email a concierge for travel advice. Verified students receive Premium at $4.99 per month or $49.99 per year. The Platinum Tier ($19.99 per month or $199.99 per year) provides the highest limits (10 smart itineraries per month, up to 10 days per itinerary, unlimited saved itineraries) plus mid-trip suggestions, priority support, and early access to new features. A separate concierge product, The Crown ($79.99 per trip), provides hands-on planner verification and is available on any tier. All tiers include access to destination intel, safety guides, the budget calculator, group expense tools and the AI travel chatbox.

5.2 Billing Terms

Paid subscriptions are billed monthly or annually through our payment processor, Stripe. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or the Stripe billing portal, but no refunds will be provided for partial billing periods except as described below. Refund requests may be considered on a case-by-case basis if submitted within 7 days of the initial subscription charge. We reserve the right to modify subscription prices with 30 days advance notice. Price changes will not affect current billing periods.

6. Acceptable Use Policy

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Specifically, you shall not use the Service for any illegal purpose or in violation of any local, state, national or international law, attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service, interfere with, disrupt or create an undue burden on the Service or its underlying infrastructure, use any automated means including robots, scrapers or data mining tools to access, collect data from or interact with the Service without our express written permission, use the chatbox to generate content that is harmful, abusive, threatening, defamatory, obscene or otherwise objectionable, share your account credentials with any third party or allow multiple users to access the Service through a single account, or attempt to circumvent any usage limits, access controls or security measures implemented by the Service.

7. Intellectual Property Rights

The PINYA platform, including but not limited to its design, code, trademarks, logos and brand elements, is owned by PINYA and protected by applicable intellectual property laws. You retain ownership of content you create through the Service, including trip plans, preferences and notes. However, by using the Service, you grant PINYA a non-exclusive, worldwide, royalty-free license to use, store and process your content solely for the purpose of providing and improving the Service. Smart itineraries are provided for your personal, non-commercial use. PINYA retains the right to use anonymized and aggregated data derived from user activity to improve the Service, develop new features and for statistical analysis.

8. Concierge Booking Service

PINYA offers a concierge booking feature for Premium and Platinum tier subscribers. Through this feature, you may submit booking requests for flights, hotels, tours and other travel services. The PINYA team will then research and coordinate those bookings on your behalf. You acknowledge and agree that the concierge service is a request-based service. Submitting a booking request does not guarantee that the requested booking will be fulfilled at any particular price or availability. PINYA acts as an intermediary to assist with booking coordination. PINYA is not a licensed travel agent, tour operator or travel agency. All bookings arranged through the concierge service are ultimately between you and the third-party travel provider. PINYA is not liable for cancellations, changes, service quality or any other issues with third-party providers. Platinum tier subscribers receive priority handling of concierge requests, but priority status does not guarantee faster fulfillment or specific outcomes.

9. Community Itinerary Sharing

9.1 User-Shared Content

PINYA allows users to share itineraries publicly through the community browse feature. By sharing an itinerary publicly, you grant PINYA and other PINYA users a non-exclusive, royalty-free license to view, save and use that itinerary for personal travel planning purposes. You represent that any itinerary you share does not contain content that is unlawful, defamatory, obscene or otherwise objectionable, and does not infringe the intellectual property rights of any third party.

9.2 Moderation

PINYA reserves the right to review, remove or restrict access to any user-shared itinerary at any time, for any reason, without prior notice. This includes but is not limited to content that violates these Terms, contains inappropriate material or is flagged by other users. PINYA is not obligated to monitor all shared content but may do so at its discretion.

9.3 Saved Community Itineraries

When you save an itinerary shared by another user, that itinerary is copied to your account. If the original creator removes or modifies their shared itinerary, your saved copy will not be affected. PINYA does not guarantee the accuracy or quality of community-shared itineraries.

10. Group Travel and Budget Tools

PINYA provides a group travel expense splitting tool and a budget calculator to help you estimate and divide travel costs. These tools are provided for informational and convenience purposes only. You acknowledge and agree that calculations produced by these tools are estimates and may not reflect actual costs, exchange rates or tax obligations. These tools do not constitute financial, tax or accounting advice. You are solely responsible for verifying all financial calculations and for any financial decisions or transactions you make based on these tools. PINYA is not liable for any financial losses or disputes arising from the use of these tools.

11. No Travel Agency Services

PINYA IS PRIMARILY A PLANNING TOOL. Except as described in Section 8 (Concierge Booking Service), PINYA does not book flights, hotels, transportation, tours or any other travel services on your behalf. We do not guarantee the availability, pricing or quality of any travel service, accommodation or experience mentioned in any itinerary or recommendation. We accept no liability for any bookings, reservations or purchases you make based on PINYA suggestions or content.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PINYA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL PINYA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO PINYA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH YOUR CLAIM IS BASED.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PINYA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. PINYA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. PINYA MAKES NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF ANY GENERATED CONTENT OR ANY OTHER CONTENT AVAILABLE THROUGH THE SERVICE.

14. Indemnification

You agree to indemnify, defend and hold harmless PINYA, its officers, directors, employees, agents and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of a third party or any travel decisions or arrangements you make based on content provided through the Service.

15. Privacy

Your use of PINYA is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use and protect your personal data. We also maintain an AI Transparency page detailing how AI is used in the Service and what data is processed by AI systems.

16. Account Termination

You may delete your account at any time through the Settings page. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent or abusive behavior or pose a security risk to the Service or other users. We may also terminate accounts that have been inactive for an extended period. Upon termination, your right to access and use the Service will immediately cease.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email to the address associated with your account or through a prominent notice within the Service. Changes will become effective upon posting unless otherwise specified. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the District of Columbia, without regard to its conflict-of-laws principles. We encourage you to contact us directly at travel.sweeter@gmail.com to resolve any concerns before pursuing formal legal remedies. In the event a dispute cannot be resolved through good-faith discussion, you agree that the exclusive venue for any action arising from or related to these Terms or the Service shall be the courts located in the District of Columbia, and you consent to the personal jurisdiction of those courts. You agree that any cause of action arising from or related to the Service must be commenced within one (1) year after the cause of action accrues, or the claim will be permanently barred.

19. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.

20. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and PINYA regarding your use of the Service and supersede all prior or contemporaneous communications, representations or agreements, whether oral or written.
